Immigration

Immigration law is one of the most complex and fast changing areas of law. It is important to have a knowledgeable attorney to analyze your needs and recommend a plan of action. At Missan Law Office, we can help you with many different needs:

An immigrant typically enters the country on a visa. There are dozens of different types of visas. It is important to take the time to understand the visa you have. Some visas allow you to work, others do not. Some visas are renewable multiple times, others may not be renewed. If you have a visa problem, we can help you to renew your visa or apply for another type of visa.

A permanent resident is a citizen of another country who has been authorized to permanently stay in the United States. Permanent residency most commonly arises through marriage to a united states citizen. The process for applying for a permanent residency is complex and confusing. A permanent residency arising through marriage will initiatlly be conditional and last for 2 years. After two years the permanent residency must be reviewed or it will expire. Once a non-conditional permanent residency has been granted, the permanent residency will last for 10 years at a time.

A permanent resident can apply for citizenship after three years if they are married to a US citizen or 5 years if they obtained permanent residency in some other way. Citizenship requires that the permanent resident know English, take a test, and swear allegiance to the United States.

Unfortunately, a criminal conviction can sometimes lead to deportation from the United States. If you are not a US citizen, you should have your criminal case reviewed by an immigration attorney before entering a guilty plea. Even a plea to a misdemeanor can lead to deportation.

If you have already been convicted of a crime, it may still be possible to allow you to stay in the United States There are a variety of arguments to be made and motions to be filed that can prevent deportation. Our knowledgeable attorneys can review a deportation case and tell you if it is possible to help you.
